Binding Legal Agreement

These Terms and Conditions form a legally binding agreement between you and Datawell regarding your use of our website, services, and database management training courses.   • 1.3 Warranties that the services will be uninterrupted, secure, or error-free
  • 1.4 Warranties regarding specific outcomes or career advancement from course completion

2. Limitation of Liability

To the maximum extent permitted by law, Datawell shall not be liable for:

  • 2.1 Any indirect, incidental, special, consequential, or punitive damages
  • 2.2 Loss of profits, revenue, data, or use
  • 2.3 Business interruption or loss of business opportunities
  • 2.4 Damages arising from your reliance on course content for professional decisions

Our total liability to you for all claims shall not exceed the amount you paid to us for the specific service giving rise to the claim within the twelve months preceding the claim.

3. Exclusion of Consequential Damages

We expressly disclaim liability for any consequential, incidental, or special damages including but not limited to lost time, lost opportunities, or damages resulting from errors or omissions in course content. This applies even if we have been advised of the possibility of such damages.

4. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, government actions, telecommunications failures, or power outages.

5. No Professional Advice

The information provided in our courses is for educational purposes only and should not be construed as professional advice. We do not guarantee specific career outcomes, certifications, or job placements as a result of completing our courses. Your individual results may vary based on numerous factors beyond our control.

Legal Provisions and Dispute Resolution

1. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that:

  • 1.1 Any legal action or proceeding shall be brought exclusively in the courts of New Delhi, India
  • 1.2 You consent to the personal jurisdiction of such courts
  • 1.3 You waive any objection to venue in such courts

2. Dispute Resolution Procedures

  • 2.2 We will attempt to resolve the dispute in good faith within 30 days
  • 2.3 If informal resolution fails, either party may initiate formal proceedings
